Title Deed Transfer in Ethiopia From Abroad

A title deed in Ethiopia changes hands only when the land office records the change. You do not have to fly home for that. Someone can do it for you under a power of attorney, and the office says so in writing. This guide shows the steps, the papers each office asks for, and what nobody publishes.

What the title deed is

In Addis Ababa the deed is the holding certificate, the "carta". The Addis Ababa Landholding Registration and Information Agency issues it. Its head office is at Megenagna. The name transfer itself is done at the sub-city office, in person.

The federal law is new. Proclamation No. 1381/2025 replaced the old urban landholding registration law, No. 818/2014, in July 2025. It says a sale, a gift or an inheritance must be registered.

Can someone do it for me?

Yes. The agency's citizen charter lists what an agent must bring for a name transfer: proof of the power of attorney, and the agent's own ID.

The Civil Code (Art. 2205) says an agent may not, without special authority, sell or give away real estate or make donations. Whether your paper gives that authority is a question for your advocate. Ask the sub-city office too whether any current rule limits a sale by power of attorney.

If you, or the person receiving the property, hold a foreign passport, whether you may hold property in Ethiopia is a question for your advocate. Ask before you start.

Step 1: the power of attorney

You make it abroad, and then it gets its stamp. The embassy in Washington says that since 2 April 2026 this work runs through the Digital MoFA online system. For property, its power of attorney page asks for a copy of your passport, and of your Ethiopian Origin ID if you hold one. Ethiopia has not joined the Hague Apostille Convention. An apostille does not work here.

Step 2: the contract

A sale or a gift needs a written contract. The Civil Code says it must be in writing, registered, and signed before two witnesses. Proclamation 922/2015 says a contract that sells or gives away property is signed before the authentication office, with two witnesses.

The land office asks for a contract "approved by the legally authorised body". Ask your advocate, and the office, which body that is for your contract today.

Step 3: the papers the sub-city office asks for

The agency's citizen charter lists these for a name transfer, among others:

  1. The application form.
  2. ID: a renewed kebele ID, a passport, a driving licence or a TIN card.
  3. If an agent applies: proof of the power of attorney, and the agent's ID.
  4. The original holding certificate, and a copy.
  5. Two 3x4 photos of each holder.
  6. The approved sale or gift contract, and the lease contract.
  7. For leased land: proof the lease payments are done, or a new lease where the new holder takes on what is left.
  8. For a condominium: proof the bank loan is paid off and, for a home, proof the 5 year hold period has ended.
  9. Payment of the service fee.

For an inheritance, the office also asks for the court decision, the court approved estate report, proof of each heir's share and their agreement, and, for leased land, proof the lease debt is paid or agreed.

Step 4: taxes and duties

The law sets the tax and duty rates, not us. Which office collects each one is not published in a form we could check. Ask the sub-city office before you pay.

A sale can also carry capital gains tax under the Federal Income Tax Proclamation, which was amended in July 2025 (Proclamation 1395/2025). Whether it applies to your sale, and at what rate, is a question for your advocate or a tax adviser.

The agency lists its own fee schedule, but the file would not open when we checked. We will not guess the amount. Ask the office.

Who pays? Taxes and duties worked out on the property's value are paid by the buyer or seller who owes them, straight to the office or bank that collects them. They never pass through us. The only official fees we pay for you are the offices' own service fees, and you get the receipt for each one. The sale price goes straight from the buyer to the seller. It never passes through us either.

How long it takes

The official sources do not agree. The agency's draft citizen charter, dated October 2023, gives 3 hours for a name transfer at the sub-city office. One of its service pages gives 2 days, though its wording is unclear. A World Bank study of 2019 counted 52 days from start to finish.

The law also lets the city pause transfers in an area while holdings are checked, for up to five months. Parts of Addis Ababa have had such pauses. Ask the sub-city office whether one covers your area before you start.

A lost deed, a copy, or checking a deed

These are smaller jobs, done at the same sub-city office.

  • A lost or damaged deed. The office asks for proof of the loss from the proper authority and the newspaper notice, or the damaged certificate, and you sign an undertaking. The charter gives 48 minutes. The law says under one month.
  • A copy of the land record. You bring the original certificate and a copy. The charter gives 30 minutes.
  • Checking what is registered. The office gives out land and holding information. An agent needs a power of attorney and ID. A copy counts as evidence only with the registrar's signature, the stamp, the date and a reference number.

Adama

The Adama city e-service lists land transfer and change of ownership among its land services. We found no published list of papers or times for it. Ask the Adama land office before you start.

Can I transfer a title deed in Ethiopia from abroad?
